Halo 3 Australian edition leaked

360 News | And sold on eBay.
There is little doubt that Halo 3 will be one of the biggest games of 2007. With the game set for release in just a few short weeks, the rabidly impatient among us can't wait any longer for September 25 to roll around. Unfortunately, an enterprising seller on eBay has made the wait all the more painful by placing, and subsequently selling two leaked Australian copies of the game on eBay for the somewhat paltry sum of AU $149.00.

IGN spoke to Microsoft Australia about the leak and asked whether the company will be tracking the culprits down - to which they responded with an unsurprising "no comment". IGN also queried Microsoft on whether they would ban the Xbox Live account of a user playing Halo 3 before the launch date, to which yet another revelatory "no comment" was given.

It's still unclear how the copies of the games were leaked in the first place, but if anything is certain, there's going to be a lot of PAL Halo fans kicking themselves for not window shopping on eBay more often.

And Microsoft can't really ban the people who bought it, it's a legit auction and the seller is in the wrong here.
Knowingly buying stolen goods is also illegal.
The next few weeks is going to be interesting with all the Halo Hype, nevermind the fact I couldn't give a s*** about this game.
Just because something was sold early doesn't make it illegal, I'd plead ignorance.

Sold by someone on ebay before the game was officially released. I'd say that sounds pretty illegal to me.

Well tbh if the person is selling it publicly on eBay I'd think it was either legit or the guy selling is a giant jackass

I don't know why it popped in to my head, but I just thought of something that Microsoft could be doing. They might be behind it all. They could be doing it to ban modded xbox 360 off of Live. They make this (fake) ebay listing, then, a few days later release a special version of Halo 3 over the internet, on torrents, Emule, all that stuff, that has a different code to the real version released on September 25th.

Then they ban any Xbox off of Live with that code in it's played games. Or something. It could actually work. If I had a modded console and could get my hands on Halo 3 2 weeks before release, then I would, and I'm sure all others would to. But then Microsoft would have Halo 3 released early, and they don't want that.


As highly unlikely as that is, It just popped in to my head out of nowhere and i wanted to say it. And it would be much more complex than what I said.

as for bringing legal action against the buyer, on what grounds?
it's the seller who broke the street date, any breach of contract (which street dates typically are - especially for something as large as this) is on the part of the seller, not the buyer.

i also don't see there being anything MS can do against the buyer either - as i say, legally they've done nothing wrong, only the seller. handing down a ban could feasibly bring about some legal action against MS - although there is probably some small print in the TOS about registering games pre-release.

First off, there’s been no confirmation that they’re stolen. Second, the buyer is in absolutely no trouble whatsoever. It will be extremely difficult to pin anything on the buyer, as the product itself isn’t seen as being illegal.

I’m guessing the reason for the low price is because he/she wanted to stay off the radar, but didn’t actually understand just how much of a big deal this actually is. Obviously due to someone in the industry, but more likely someone with a contact who isn’t all that informed about the legalities of selling games early... especially ones as high profile and early as this. I don’t know, I just can’t believe this is actually the case, as it’s a huge blow for both Microsoft and Bingie. You’d be hard pressed to find a Japanese developed game of same stature in the same situation.

The seller is easily one of the stupidest people alive. Probably one of the same people who think video games are solely for children. The same type of person who thinks we don’t need an “R” rating. The same person who continues to blame video games for all the worlds evils. The same bloody... ... Ahem. Yay for Halo 3! icon_biggrin.gif

anyone considering it was MS selling it to see what kind or response it would stir? and to hype up the game as much as possible in the news/internet??? my 2 cents there

yes. because Halo 3 needs all the hype it can get.
