DOA producer hit with sexual harassment suit

According to a report on Japanese website Zakzak, a former female employee of Tecmo has filed a sexual harassment suit against her previous co-worker Tomonobu Itagaki, creator of the successful Dead or Alive series, for a number of events dating back to September 2003.

The victim claims that after dining at a company-sponsored event the two had shared a taxi ride home, where Itakgaki allegedly groped her and continued to force unwanted sexual advancements. The report cites that Itagaki had made similar actions with the victim by locking her in a conference room and during a game convention in the US during May of last year.

The woman mentioned her disgust with Tecmo and the firm's handling of the situation, with the employee being told to handle the situation herself. Tecmo has recently appointed a new personnel manager, where she brought up the issue again, and since then Itagaki has been demoted from his managing role to a regular executive officer, which is likely to be due to this lawsuit.

Itagaki, who is married with children, admits kissing the woman, but claims that it was consensual. The suit was filed on September 10, 2006, with the woman seeking ¥10 million (roughly AU$110,000 or £45,000) in damages.

We don't know all the facts so its pretty had to make a true assessment of this. There is a point I'd like to bring up regardless if its true or not in this case, but what constitutes giving consent?

If a man makes sexual advances on a woman and kisses her and she struggles, but then relents and lets him do it because she's not strong enough to resist physically, does that mean she consented to it?

If a woman is being raped and she relents because the man overpowers her and she's not strong enough to resist, does that mean she's consenting to being raped?

Its what happens at the start not afterwards, if she resists she obviously dosent want it to happen. Thats when your ment to step back, once you have pushed that line its ****, no matter if she just lets it happen or not. Im sure most **** victims didnt try and struggle to much because of the danger of getting hurt any further.. Really sad stuff.

^ To clarify, it isn't just at the "start" as consent can be withdrawn at any point in time.

Also, I hope you weren't referring to the picture of the individual with flowing locks in the PALGN article in your earlier post...

What I don't like with these huge corporate scandals is you can never really know the full truth.
Is she doing this for the money and publicity and to shame Tecmo?
Or
Was Itagaki being a bad boy.

And I agree on the above.
Anytime the woman wants to pull out the guy has to respect her wishes.Otherwise you're a piece of sh!t and deserve to get your nuts crushed with a hammer.I'd gladly do it free of charge.

When typing that I had to have dinner so I couldn't correct it.

I meant that I won't unless there's an obvious sign that its welcomed. If I did start kissing them passionately and they wanted to stop I would the instant they tell me, or push me away. But I've never been in that situation because the girls I've kissed have wanted me to.

Not many mind you because there's only been two women in my life and the second is who I'm with now.

Regarding what was said above, the crimes act states "a person who does not offer actual physical resistance to sexual intercourse is no, by reason only of that fact, to be regarded as consenting to sexual intercourse" from s61R(2)(d). So no, just because she seems to be 'going with it' doesn't mean she's consenting. And in the case of her struggling at first but then going with it, that's known as submission and does not in any way mean consent.

The crimes act never positively defines what consent is, it's just known as free agreement. Consent is only defined in common law due to its circumstantial nature, so it's really hard to just say "oh this is what consent is".

When I said at the start I was reffering to rodvcpetrie's post in which he was asking what would happen if the lady just let her body go after she said no. I was saying its what she says at the start thats the answer - in that case.

But I don't get why this is a major story? Maybe he wanted a taste of the real thing, after looking at virtual chicks all day?
